Accelerated Medallion Signature Guarantee process
Medallion Signature Guarantee stamps are a statutory requirement for the transfer of securities in North America, and the programme is overseen by the American Securities Exchange Commission (SEC).
The Medallion Signature Guarantee stamp verifies the validity and authority of the person initiating the transfer. The stamp is intended to prevent unauthorised transfers and features a special security ink.
The stamp must be placed on the Transfer Request Form to prove to the transfer agent that the signature is genuine, and the signatory is legally authorised to sign.
The transfer agent is then able to proceed with their instruction to transfer or sell the stock.
When administering an estate with shares traded on the US or Canadian Stock Exchanges, you’ll likely need a Medallion Signature Guarantee before the shares can be transferred or sold. Federal Tax Clearance from the Internal Revenue Service (IRS) is required if the shareholdings and funds are worth more than $60,000USD at the time of death. When a US account becomes dormant for the specified time period as set out by state law, it is transferred to the state and usually liquidated. If this happens, the escheated funds can still be reclaimed, however, it is often a lengthy and protracted process.
